We do use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.

We also collect some Personal Information that does not directly fit within one of the categories defined by the CCPA. For example, we collect the contents of communications you send to us and language preference. Unless otherwise specified, the sources of this Personal Information, the purposes for which we use it, and the categories of persons to which we disclose it are the same as those listed for Identifiers.

How Long We Keep Your Personal Information

We keep the categories of Personal Information described above for as long as is necessary for the purposes described in this Notice or otherwise authorized by law. This generally means holding the information for as long as one of the following apply:

 

  • Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
  • Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected;
  • The information is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or

2. HOW WE SHARE AND SELL PERSONAL INFORMATION

Under California law, a “sale” of Personal Information does not necessarily involve an exchange of money. Instead, the term also includes disclosures of Personal Information to third parties that may use the information for their own purposes, such as cookie providers. The categories of recipients to whom we may have sold and shared Personal Information include our vendors and other third parties for cross-context behavioral advertising, as well as other marketing and advertising services that we utilize on our digital properties. We only “sell” Personal Information to third parties as defined in the CCPA for the purposes of cookies or other tracking technologies. We do not have actual knowledge that we sell or share the Personal Information of consumers under 16 years of age.

3. SUBMITTING REQUESTS RELATING TO YOUR PERSONAL INFORMATIONHOW WE SHARE AND SELL PERSONAL INFORMATION

If you are a resident of California, you have the right to submit certain requests relating to your Personal Information as described below. To exercise any of these rights, please submit a request through our Privacy Portal or call us at 800-962-1413. Please note that, if you submit a request to know, request to delete, or request to correct, you will be asked to provide a name, email address, and a government ID that we will match against our records to verify your identity. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using our Privacy Portal or toll-free number listed above.

Right to Know. You have the right to know what Personal Information we have collected about you, which includes:

(1) The categories of Personal Information we have collected about you, including:

 

  1. The categories of sources from which the Personal Information was collected.
  2. Our business or commercial purposes for collecting, selling, sharing, or disclosing Personal Information.
  3. The categories of recipients to which we disclose Personal Information.
  4. The categories of Personal Information that we sold or shared, and for each category identified, the categories of third parties to which we sold or shared that particular category of Personal Information.
  5. The categories of Personal Information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of Personal Information.

Right to Delete Your Personal Information. You have the right to request that we delete Personal Information we have collected from you, subject to certain exceptions.

Right to Correct Inaccurate Information. If you believe the Personal Information we maintain about you is inaccurate, you have the right to request that we correct such information.

Right to Opt Out of Sales and Sharing of Personal Information. You have the right to opt out of the sale of your Personal Information, and to request that we do not share your Personal Information for cross-context behavioral advertising. If you choose to use the Global Privacy Control (GPC) browser signal, you will only be opted out of online sales or sharing of Personal Information, and will need to turn it on for each browser you use. Right to Limit Use and Disclosure of Sensitive Personal Information. You have the right to direct us to limit the use and disclosure of your Sensitive Personal Information to uses/disclosures that are reasonably necessary to provide our goods and services, or as needed: to ensure security and integrity; to prevent fraud or illegal activity; for physical safety; for short-term, transient use, including for non-personalized advertising; to perform services on behalf of the business; to verify or maintain the quality or safety of a service or device owned, manufactured, manufactured for, or controlled by us; and to improve, upgrade, or enhance such services or devices. Kellogg only uses and discloses your Sensitive Personal Information to provide you with personalized advertisements based on your interests and activities and for the limited purposes described in this Notice. Rights Related to Automated Decision-Making. You have the right to opt out of automated decision-making, including profiling, that we use to evaluate certain personal aspects relating to your performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements. Right to Non-Discrimination for the Exercise of Your Privacy Rights. If you choose to exercise any of your privacy rights under the CCPA, you also have the right not to receive discriminatory treatment by us.

4. NOTICE OF FINANCIAL INCENTIVE

We offer Kellogg’s Family Rewards (“KFR”), a rewards program that provides benefits such as rewards points and discounts to those who choose to participate. Participation requires you to provide some Personal Information, such as name, gender, date of birth, address, telephone number, and email address. We have made a good faith estimate that the value of consumers’ Personal Information provided in connection with KFR is equivalent to the relevant expenses related to the collection and retention of that Personal Information. Any difference in price or benefits provided to customers who participate in KFR is reasonably related to the value of the Personal Information provided. By joining KFR, you consent to any financial incentive associated with the program. You have the right to withdraw from the financial incentive at any time by cancelling your participation in KFR. Unless you specifically request, submission of a request to delete your Personal Information will not erase information required for you to continue to participate in KFR.
